WINChat User Agreement & Terms WINChat（云聊）用户服务协议

1. Scope of Services 一、服务内容

WINChat provides account registration, friend connections, group messaging, text and multimedia messaging, voice and video communications, notification alerts, digital content sharing, and associated utilities. Specific features may vary across operating platforms, geographic locations, and software versions. WINChat 提供账号注册、好友和群组聊天、文字及多媒体消息、文件传输、语音/视频通信、通知、内容分享及其他相关功能。具体功能可能因地区、设备、版本或安全策略而有所不同。

2. Account Registration and Security 二、账号注册与安全

You must provide accurate, current, and verifiable registration details and keep them updated. You are solely responsible for preserving the confidentiality of your device, passwords, and verification credentials. You must not sell, transfer, rent, or lease your account to any third party. If you suspect unauthorized access or security breaches, notify us immediately. 您应提供真实、准确且可持续使用的注册信息，并及时更新变更内容。您应妥善保管设备、密码、验证码和登录凭证，不得出租、出借、出售或转让账号。发现账号被盗、异常登录或其他安全事件时，应立即通过应用内渠道或客服通知我们。

We will never contact you through chat or informal channels to ask for your private passwords, security credentials, or secret recovery keys. 您对账号下发生的操作负责，但因我们故意或重大过失造成的损失除外。我们不会通过聊天向您索取密码、验证码或其他安全凭证。

3. User Eligibility 三、使用资格

You must possess the legal capacity to enter into a binding contract under applicable laws in your jurisdiction. Individuals under the age of legal majority may only use the Services with verified parental or guardian consent and supervision. 您必须具备所在地区法律规定的订立本协议和使用服务的资格。未达到法定年龄的用户，须在取得父母或法定监护人同意并监督下使用服务。

4. User Content and License 四、用户内容

You retain ownership of any messages, images, audio, or files you create or transmit. You grant us a non-exclusive, worldwide, royalty-free, transferable license solely to store, transmit, format, and display your content as necessary to operate and safeguard the Services. 您保留对自己创建、发送或上传内容的权利，并授予我们为运营、传输、存储、备份、展示和保护服务所必要的非独占、全球性、免版税、可转授权的使用许可。该许可在您删除内容或注销账号后，可能因备份、法律义务或已被其他用户保存而在合理期限内继续存在。

5. Prohibited Conduct 五、禁止行为

You agree not to use WINChat to: 您不得利用 WINChat：

• Engage in fraudulent schemes, money laundering, illegal gambling, harassment, threats, stalking, or incitement to violence; 从事违法犯罪、诈骗、洗钱、赌博、骚扰、威胁、跟踪或煽动暴力活动；
• Disseminate unsolicited spam, phishing scams, malware, or unauthorized commercial advertisements; 发送垃圾信息、钓鱼链接、恶意软件、未经同意的商业推广或虚假信息；
• Infringe on intellectual property, privacy, or legal rights of others, or impersonate any individual or entity; 侵犯他人隐私、盗用身份、冒充他人或未经授权收集他人资料；
• Distribute child sexual abuse material (CSAM), engage in child sexual abuse or exploitation (CSAE), grooming, or sextortion (governed strictly by our Child Safety Standards); 创建、传播儿童性虐待材料（CSAM）、从事儿童性剥削（CSAE）、诱骗儿童（Grooming）或性勒索（严格遵循我们的《儿童安全标准》）；
• Reverse engineer, decompile, disrupt the platform, or deploy automated bots to scrape data or mass-register accounts. 反向工程、破解、干扰服务，绕过安全措施，使用机器人批量注册或抓取数据。

6. Content Moderation and Reporting 六、内容治理与举报

Users can report abusive, illegal, or violating material through in-app report buttons or via email. We utilize automated detection and human review teams to investigate violations and reserve the right to restrict content, temporarily limit features, or terminate offending accounts. 您可以通过应用内举报功能或客服举报涉嫌违法、侵权、诈骗或违反本协议的内容。为保护用户和服务安全，我们可能使用自动化工具和人工审核处理举报、识别垃圾信息及调查违规行为，并可能删除内容、限制传播、暂停功能或关闭账号。

7. Intellectual Property 七、知识产权

All platform trademarks, logos, graphical designs, software code, and interface layouts belong to Bitara Capital Sdn. Bhd and its licensors. Unauthorized copying or redistribution is strictly prohibited. WINChat 的软件、界面、商标、标识、设计、文字和其他服务内容由我们或相关权利人所有。除本协议明确允许外，您不得复制、修改、出租、出售、分发、反编译或以其他方式利用。

8. Third-Party Integrations 八、第三方服务

The Services may link to or incorporate third-party technologies. We are not liable for the availability, security, or data handling practices of third-party operators. 服务可能包含第三方登录、链接、内容或功能。第三方服务由其提供者负责，您使用该等服务须遵守其条款和隐私政策。我们不对第三方服务的可用性、准确性或安全性作出保证。

9. Modification and Termination 九、服务变更与终止

You may discontinue use and delete your account at any time via the in-app deletion setting or by visiting our Account Deletion Page. We may suspend or terminate your account if you violate these terms or if legally required by authorities. 您可以随时停止使用服务并注销账号（通过 App 内注销或访问 账号注销专页）。若您违反本协议、危害他人或服务安全，或法律要求我们采取措施，我们可以限制或终止您的访问。

10. Disclaimer of Warranties 十、免责声明

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to maintain stability and security, we do not warrant that the Services will be uninterrupted, error-free, or resilient to force majeure network interruptions. 服务按“现状”和“可用”状态提供。我们会采取合理措施保持服务稳定和安全，但不保证服务始终不中断、无错误、完全满足您的需求或不会受到不可抗力、网络故障、设备问题及第三方原因影响。

11. Limitation of Liability 十一、责任限制

To the maximum extent permitted by applicable law, in no event shall we be liable for indirect, incidental, punitive, or consequential damages arising from your use of or inability to use the Services. 在适用法律允许的最大范围内，我们不对间接、附带、特殊、惩罚性或后果性损失承担责任。对于不能依法排除或限制的责任，本条不影响您的法定权利。

12. Modifications to Terms 十二、协议更新

We reserve the right to revise this agreement as regulations or features evolve. Material revisions will be notified via in-app banner or website publication. Continued use of WINChat following revisions constitutes your consent to the modified terms. 我们可能更新本协议以反映服务或法律变化。重大更新会通过应用内通知、网站公告或其他适当方式提示。更新后继续使用 WINChat，即表示您接受更新后的协议；如您不同意，应停止使用并注销账号。

13. Governing Law & Dispute Resolution 十三、适用法律与争议解决

These terms are governed by and construed in accordance with the laws of our principal place of business.
